Oral representations in objection to the application were received at the meeting.  An independent Arboricultural Report dated 22 November 2018 and a further objection dated 2 January 2019 had been received and circulated to Members.  An email from the occupier dated 2 January 2019 had also been received and circulated to Members.

 

The Chairman referred to the Arboricultural Report and reported that Ward Member, Councillor Mary Cooke’s view was that the report was inconclusive and that the trees were an attractive part of the landscape.

 

Members having considered the report, objections and representations, RESOLVED that CONSENT TO FELL TWO OAK TREES IN THE REAR GARDEN be GRANTED as recommended, subject to the conditions and informative set out in the report of the Chief Planner.

Description of application – Proposed two bedroom house on land adjacent to 41 Mounthurst Road, Hayes, Bromley, Kent, BR2 7PG.

 

Oral representations in support of the application were received at the meeting.

The Chairman referred to previously refused application 18/02599.  He objected to the scale and building line of the proposed development and his view was that the current application did not go far enough to overcome the previous grounds of refusal.  Councillor Simon Fawthrop also objected to the application.

 

Members having considered the report, objections and representations, RESOLVED that PERMISSION BE REFUSED for the following reason:-

1.  The proposed development, as a consequence of its design, layout and restrictive size of the site, would result in a cramped form of development which would be out of keeping with the prevailing pattern of residential development and spatial characteristics of the locality, being discordant within the streetscene and unacceptably harmful to the character and appearance of the area. As such it would conflict with Policies H7, H9 and BE1 of the London Borough of Bromley Unitary Development Plan July 2006, Policies 3.5 and 7.4 of the London Plan March 2016; Policies 4, 8 & 37 of the Local Plan (Submission Version 2017) &Supplementary Planning Guidance No 1 General Design Principles, and Supplementary Planning Guidance No 2 Residential Design.

Description of application – Increased height of single storey rear extension, new front porch and elevational alterations PART RETROSPECTIVE APPLICATION.

 

Oral representations in objection to the application were received at the meeting.  The Chief Planner gave an update and referred to application 17/02441 and the Breach of Condition Notice dated 21 December 2018 served in relation to it.

 

The Chairman and Councillor Peter Dean regretted the development had not been built in accordance with application 17/02441 and supported the minor alterations to that permission.

 

Councillors Marina Ahmad, Michael Turner and Simon Fawthrop disapproved of retrospective applications and objected to the application.  Councillor Dean informed Members that he was totally opposed to retrospective applications but his decision had to be based on the application before him.

 

The Chief Planner referred Members to the differing measurements between the two applications contained in his report and confirmed that the current application related only to that difference.

 

 

Members having considered the report, objections and representations, RESOLVED that PERMISSION BE REFUSED for the following reasons:-

1.  The proposed single storey rear extension, by reason of its increased height, would result in an overdevelopment of the property, harmful to the residential amenities of the neighbouring dwellings, thereby contrary to Policy BE1 of the Unitary Development Plan.
