Description of application – Change of use of ground floor from former members social club (Sui Generis) to restaurant (Use Class A3) Front elevational changes to incorporate stairs.

 

Oral representations in objection to and in support of the application were received at the meeting.  It was reported that further objections to the application had been received.

Members having considered the report, objections and representations, RESOLVED that PERMISSION be GRANTED as recommended, subject to the conditions set out in the report of the Chief Planner with an amendment to Condition 2 and three further conditions to read:-

“2. Customers shall not be admitted to the premises before 11:00 hrs on any day, or after 23:00 hrs Monday-Saturday, or after 22:00 hrs on Sundays and Bank Holidays. All customers shall vacate the premises no later than 24:00 hrs Monday – Saturday and 23:00 hrs Sundays and Bank Holidays.

REASON: In order to comply with Policy S9 of the Unitary Development Plan and in the interest of the amenities of nearby residential properties.

5. The use hereby permitted shall be permissible solely within the ground floor of the application premises  (as denoted within drawing number 01 –B).

REASON;  In order to comply with Policy BE1, Policy S1 and Policy S9 of the Unitary Development Plan and in the interest of the amenities of the area.

6. Customers visiting the premises are excluded from using the outdoor areas at all times inclusive of the front and rear outdoor amenity space.

REASON:  In order to comply with Policy BE1, Policy S1 and Policy S9 of the Unitary Development Plan and in the interest of the amenities of the area

7.  Prior to the commencement of the development, detailed plans of the appearance of and the equipment comprising a ventilation system which shall include measures to alleviate fumes and odours (and incorporating activated carbon filters where necessary) shall be submitted to  and approved by the Local Planning Authority; after the system has been approved in writing by the Authority, it shall be implemented in accordance with the approved details before the use hereby permitted first commences and shall thereafter be permanently retained in an efficient working manner.

REASON: In order to comply with Policies S9 and ER9 of the Unitary Development Plan and in the interest of the visual and residential amenities of the area.”
