Decision:

That the making of a ‘non-immediate’ Article 4 Direction (covering the Knoll Area of Special Residential Character, as defined in the Bromley Local Plan) to withdraw the permitted development right granted by Part 2, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (“the GPDO”), Schedule 2, which allows the erection or construction of a gate, fence, wall or other means of enclosure be endorsed.

 

Reasons for the decision:

Article 4 Directions allow authorities to withdraw the PD rights that would otherwise apply by virtue of the GPDO. An Article 4 Direction does not prevent the development to which it applies, but instead requires that planning permission be first obtained from the local planning authority for that development. This gives a local planning authority the opportunity to consider a proposal in more detail.
