Description of application – Fell two Oak trees in rear garden. SUBJECT TO TPO2222 (T1 and T2).

 

Oral representations in objection to and in support of the application were received at the meeting.

 

Further objections to the application were received and circulated to Members of the Committee.

 

Written comments from Ward Member Councillor Mary Cooke were also circulated.

 

The Principal Tree Officer reported that pruning the trees to combat subsidence would require a 70% cut back which would send the trees into a steep decline and ultimately result in their death.  Whilst trees may respond well to a 30% reduction, in this particular case, it would not have the desired effect on the soil conditions.

 

The Legal Representative advised that should Members be minded to defer or refuse the application, the Council may still be subject to a compensation claim by the applicant for damage, non-determination or both.

 

Members having considered the report, objections and representations, RESOLVED that the application BE DEFERRED without prejudice to any future consideration, to enable the Council to obtain an independent assessment.
