PERMISSION SUBJECT TO SECTION 106 AGREEMENT

 

Minutes:

Description of application – Elevational alterations and single storey extension to garage and conversion of resultant building to 2 bedroom annexe for use by a family member with disability.

 

Members having considered the report and objections, RESOLVED that PERMISSION BE GRANTED, SUBJECT TO THE PRIOR COMPLETION OF A LEGAL AGREEMENT that THE RESIDENTIAL ANNEXE BE OCCUPIED ONLY BY DEPENDENT RELATIVE OF THE OCCUPIERS OF THE HOST DWELLING AT NO. 250 UPPER ELMERS END ROAD AND SHALL NOT BE SEVERED AT ANY TIME TO FORM A SEPARATE INDEPENDENT DWELLING BY CURRENT OR FUTURE OWNERS/OCCUPIERS OF THAT PROPERTY, as recommended, and subject to the conditions and informative set out in the report of the Chief Planner with a further condition and informative to read:-

“4.  Notwithstanding the provisions of the Town and Country Planning (General Permitted Development)(England) Order 2015 (or any Order amending, revoking and re-enacting this Order) no building, structure or alteration permitted by Class A or E of Part 1 of  Schedule 2 of the 2015 Order shall be erected or made within the curtilage(s) of the dwelling(s) hereby permitted without the prior approval in writing of the Local Planning Authority. 

REASON: In order to prevent an overdevelopment of the site and to accord with Policies BE1 and H8 of the Unitary Development Plan.

INFORMATIVE 2:  The applicant is advised to consider the internal layout of the proposed annexe in terms of provision of disabled facilities.”
