CERTIFICATE OF LAWFULNESS GRANTED

Description of application – Loft conversion with set back hip to gable and set back rear dormer and rooflights to front LAWFUL DEVELOPMENT CERTIFICATE (PROPOSED).

At Councillor Fawthrop’s request a copy of a delegated refused decision dated 28 August 2019 with regard to 52 Towncourt Crescent, Petts Wood, (DC/19/03690/PLUD) had been circulated to Members together with a Court of Appeal decision dated 18 February 2014, Barnwell Manor Wind Energy Limited v East Northamptonshire District Council and Others.

Members having considered the report, RESOLVED that a CERTIFICATE OF LAWFUL DEVELOPMENT be GRANTED as recommended,subject to the condition set out in the report of the Assistant Director, Planning.
