PERMISSION, CONDITIONS TO BE DETERMINED UNDER DELEGATED AUTHORITY

Minutes:

Description of application - Redevelopment of 1960's squash courts within the Old Dunstonian RFC complex, providing the following -

Change of use from Class D2 (Squash Courts) to Class D1 (Day

nursery), additional changing/WC facilities to be used by the tennis

courts, refurbishment of existing building and alterations to the external building fabric to meet building regulations.

 

Oral representations in support of the application were received.  Oral representations from Ward Member, Councillor Peter Dean, in support ofthe application were received at the meeting.

 

Emails dated 25 and 26 November 2020 had been received from Councillor Christine Harris and circulated to Members.  An email dated 26 November 2020 from Councillor Mary Cooke, Member for adjoining Ward Shortlands, in objection to the application had been received and circulated to Members.

 

Members having considered the report, objections and representations, RESOLVED that PERMISSION be GRANTED AGAINST OFFICERS’ RECOMMENDATIONS. ACCORDINGLY, THEY RESOLVED TO APPROVE THIS APPLICATION AS THEY CONSIDERED AMONGST OTHER THINGS IN THIS CASE WITH A SUITABLE TRAVEL PLAN AND PARKING MANAGEMENT PLAN, THE SIGNIFICANT  NEED FOR NURSERY PLACES LOCALLY, THE IMPACT ON TRAFFIC BEING MINIMAL AND A SIMILAR APPLICATION WAS APPROVED A SHORT DISTANCE AWAY IN THE SAME ROAD THAT THIS APPLICATION WAS ACCEPTABLE IN THIS LOCATIONsubject to the following conditions and informative:-

1. The development hereby approved shall be begun not later than 3 years from the date of this decision notice.

REASON: To comply with Section 91 of the Town and Country Planning Act 1990.

2. a) The children attending the day nursery shall be between the ages of 2 and 5 years and not more than 40 children shall be accommodated at any one time.

(b) The use of the premises for the purpose permitted shall be limited to Monday to Friday inclusive and only between the hours of 7.30am and 6pm.

REASON: In the interest of the amenities of nearby properties, the free flow of traffic and conditions of highway safety and the continued sports use of the site, to comply with Policies 37, 30, 31, 32 and 50 of the Bromley Local Plan.

3. Prior to the first use of  the land or building hereby permitted, parking spaces and/or garages and turning space shall be completed in accordance with the approved details and thereafter shall be kept available for such use and no permitted development whether permitted by the Town and Country Planning (General Permitted Development) Order (England) 2015 (or any Order amending, revoking and re-enacting this Order) or not shall be carried out on the land or garages indicated or in such a position as to preclude vehicular access to the said land or garages.

REASON: In order to comply with Policies 30, 31, and  32 of the Bromley Local Plan and to avoid development without adequate parking or garage provision, which is likely to lead to parking inconvenient to other road users and would be detrimental to amenities and prejudicial to road safety.

4. Prior to the first use of the building, a Travel Plan for the Nursery school comprising immediate, continuing and long-term measures to promote and encourage alternatives to single-occupancy car use and alternative modes of transport shall be submitted to and approved in writing by the Local Planning Authority. The approved Travel Plan shall be implemented, monitored and reviewed in accordance with the agreed travel plan targets to the satisfaction of the Council.

REASON: in order to deliver sustainable transport objectives including a reduction in single occupancy car journey and promote the use of public transport, walking and cycling and to comply with Policies 30, 31 and 32 of Bromley Local Plan.

5. Prior to the first use of the building, details of a Parking and Access Implementation Management  Plan including details of use traffic marshals responsible to maintain and facilitate traffic movement associated with the nursery together  with details of bicycle parking/pram storage facilitiesshall be submitted to and approved in writing  by the Local Planning Authority. The approved details shall be implemented, monitored and reviewed during the lifetime of the development.

REASON: In the interests of highway safety and to minimise the impact of the development upon congestion and to comply with Policies 30, 31 and 32 of Bromley Local Plan.

INFORMATIVE: Sustainable travel mode including walking shall be promoted and encouraged by the future operator.”
