VARIATION APPROVED

Description of application – Variation of condition 1 of approval 10/02490/VAR granted for varied opening hours to permission 09/01899/FULL3 (Shopfront and change of use to mixed use comprising retail (Class A1) and cafe (Class A3)) to permit opening hours of:

Monday to Saturday 07:00 - 23:30

Sundays and Bank Holidays including Good Friday and Xmas Day - 07:00 - 22:30

New Year’s Eve 07:00 - 02:00

Oral representations in objection to and support of the application were received at the meeting.

Comments from Ward Member Councillor Cuthbert in support of the application were reported at the meeting.

Members having considered the report, objections and representations, RESOLVED that the VARIATION OF CONDITION BE GRANTED as recommended, subject to the conditions and informatives set out in the report of the Assistant Director, Planning with conditions 1 and 3 amended to read:-

Condition 1:

1.  The use shall not operate before 0700 and after 22.30 on Mondays to Sundays and Bank Holidays and shall not operate before 0700 and after 00.30 on the morning following New Year's Eve.

Reason: In order to comply with the terms of the application, in the interest of the residential amenities of the area and to accord with Policies 96 and 37 of the Bromley Local Plan.

Condition 3:

3.  The use of the pavement seating area for customers of the host cafe shall be limited to the hours 07.00 - 21.00 (Monday to Friday), 08.00 - 21.00 on Saturdays and Sundays.

Reason: In the interest of the residential amenities of the area and in the absence of a noise assessment relating to the impact of the seating area in terms of noise and disturbance to local residents, to accord with Policies 119 and 96 of the Bromley Local Plan.
